Gift transfers often fail on paperwork. The mechanism itself is simple; the file is not. This page sets out the complete document set, the Power of Attorney rules, and the attestation chain for foreign certificates — a common failure point.
For corporate parties, add: trade licence, certificate of incorporation, share certificate, memorandum and articles of association, and a board resolution identifying the authorised signatory.
Where the donor or donee cannot attend the trustee appointment, a compliant POA attends for them. Two checks apply. The POA must specifically authorise the gift action — a general property POA is not accepted for a gift. And its authenticity, scope, current status and acceptance requirements must be confirmed through the issuing authority and the receiving DLD service: a QR code should lead to an official verification record, and an older or foreign-issued instrument may need additional checks. DLD has issued guidance (Circular No. 29/R/2025) on the acceptance of foreign-issued POAs; confirm the current requirements with the receiving DLD service. The UAE is not a party to the Hague Apostille Convention. An apostille alone therefore does not make a foreign certificate usable in a Dubai gift transfer. Every foreign civil or corporate document must complete the consular legalisation chain:
Each link is independent, and a missing link stops the transfer. The chain is also the long pole in any gift-transfer timeline involving foreign documents: it runs through two countries and cannot be compressed by anything done in Dubai. Files should begin with the attestation, not end with it.
The recurring documentary failures at the trustee desk: a foreign certificate carrying only an apostille and no embassy or MOFAIC step; relationship proof reliant on documents lost or never issued (older marriage certificates, foreign birth records); name mismatches between civil documents and the title deed; expired Emirates IDs or passports on the appointment day; generic POAs, or POAs whose authenticity, scope or current status cannot be confirmed with the issuing authority and the receiving DLD service; and service-charge arrears surfacing at NOC stage. Every one is preventable at file-assembly stage; almost none is fixable on the day.
